Terms of Service

Please read these Terms of Service ("Terms," "Agreement") carefully before using the services provided by Clean Gutter Protection ("Company," "we," "us," or "our"). By accessing our website, requesting an estimate, scheduling services, or otherwise engaging with Clean Gutter Protection, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our services.

1. Service Agreement

1.1 Description of Services. Clean Gutter Protection provides professional gutter protection installation, gutter cleaning, gutter repair, gutter installation, and related home exterior services (collectively, "Services"). The specific scope, materials, and pricing for your project will be detailed in a written estimate, proposal, or service agreement provided to you prior to commencement of work.

1.2 Acceptance of Estimate. An estimate or proposal provided by Clean Gutter Protection is valid for one (1) year from the date of issuance unless otherwise specified. Acceptance of the estimate, whether verbal, written, electronic, or implied by allowing work to commence, constitutes your agreement to these Terms and the specific project details outlined therein.

1.3 Service Limitations. While we strive to provide the highest quality workmanship and materials, we cannot guarantee the elimination of all gutter-related issues or the prevention of any future problems beyond the scope of our warranty. Our Services are performed according to industry standards and best practices. Results may vary based on factors outside our control, including but not limited to: existing structural conditions, environmental factors, tree coverage, weather patterns, and acts of nature.

1.4 Customer Responsibilities. As a Customer, you agree to:

  • Provide accurate and complete information required for the Services, including property ownership verification
  • Ensure clear and safe access to all work areas, including driveways, walkways, and the perimeter of your home
  • Secure or relocate pets, outdoor furniture, vehicles, and other personal property that may interfere with or be affected by the work
  • Disclose any known hazards, underground utilities, septic systems, irrigation systems, or special conditions
  • Ensure someone 18 years or older is present or available by phone during the scheduled service
  • Obtain any necessary homeowner association (HOA) approvals prior to installation

Failure to fulfill these responsibilities may result in additional charges, rescheduling fees, or delays in service completion.

1.5 Property Access and Preparation. You grant Clean Gutter Protection and its authorized representatives permission to access your property for the purpose of performing the agreed-upon Services. This includes the right to place ladders, equipment, and materials on your property as necessary. We will make reasonable efforts to protect your landscaping and property but cannot be held responsible for minor disturbances to grass, plants, or soil that may occur during normal installation activities.

2. Scheduling and Work Performance

2.1 Scheduling. Service dates are scheduled based on mutual availability and are subject to weather conditions and crew availability. While we make every effort to honor scheduled appointments, dates and times are estimates and not guaranteed. We will notify you as soon as practicable of any scheduling changes.

2.2 Weather Delays. Services may be postponed due to inclement weather, including but not limited to rain, snow, ice, high winds, extreme temperatures, or lightning. Weather-related delays do not constitute a breach of this Agreement. Work will resume at the earliest available date once conditions permit safe installation.

2.3 Work Hours. Our crews typically work during standard business hours (Monday through Saturday, 7:00 AM to 7:00 PM local time). Specific arrival times may vary. We will provide you with an estimated arrival window on the day of service when possible.

2.4 Completion Time. Most residential installations can be completed in one (1) day. However, project duration may vary based on home size, complexity, weather conditions, and unforeseen circumstances. Multi-day projects will be communicated in advance.

3. Pricing, Payment, and Financing

3.1 Pricing. All pricing is provided in your written estimate and is based on information available at the time of the estimate. Prices are subject to change if site conditions differ materially from those observed during the initial assessment, or if you request changes to the scope of work.

3.2 Additional Work and Change Orders. Any work requested beyond the original scope must be agreed upon in writing (including email or text message) before such work is performed. Additional work will be billed at our current rates. We reserve the right to decline additional work requests.

3.3 Payment Terms. Payment is due upon completion of the Services unless otherwise specified in writing. We accept cash, check, and major credit cards. For financed projects, payment terms are governed by your financing agreement with the third-party lender.

3.4 Late Payment. Invoices not paid within thirty (30) days of the due date may be subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less. You agree to pay all costs of collection, including reasonable attorney's fees, incurred by Clean Gutter Protection in collecting past-due amounts.

3.5 Deposits. Certain projects may require a deposit to secure scheduling and order materials. Deposits are non-refundable if you cancel the project after materials have been ordered or custom-fabricated.

3.6 Financing. Financing options may be available through third-party lenders. Financing approval is subject to the lender's terms and credit requirements. Clean Gutter Protection is not a lender and makes no representations or warranties regarding financing terms.

4. Warranty

4.1 Product Warranty. Clean Gutter Protection products are covered by our Triple-Lifetime Transferable Warranty, which covers materials and workmanship for as long as you own your home. This warranty is transferable to subsequent homeowners one time. Specific warranty terms, conditions, and exclusions are provided in your warranty documentation.

4.2 Warranty Exclusions. The warranty does not cover:

  • Damage caused by acts of God, including but not limited to hurricanes, tornadoes, earthquakes, floods, hail, falling trees or branches, or other natural disasters
  • Damage caused by third parties, vandalism, or negligence
  • Damage resulting from improper maintenance, modifications, or repairs not performed by Clean Gutter Protection
  • Normal wear and tear or cosmetic changes such as fading or oxidation
  • Pre-existing conditions of your roof, fascia, or underlying structure
  • Issues arising from improper roof installation or roofing defects
  • Damage caused by excessive ice, snow loads, or debris accumulation beyond normal conditions

4.3 Warranty Claims. To make a warranty claim, contact Clean Gutter Protection at (888) 507-4854 or through our website. We will inspect the reported issue and, if covered under warranty, repair or replace the affected components at no charge. Our sole obligation under this warranty is to repair or replace defective materials or workmanship; we are not liable for any incidental or consequential damages.

4.4 Maintenance Requirements. To maintain warranty coverage, you should visually inspect your gutter protection system annually and after major storms. While our system is designed to be maintenance-free, removing excessive debris accumulation on top of the guards (such as large branches or leaves following storms) helps ensure optimal performance.

5. Cancellation and Refunds

5.1 Right to Cancel. You may cancel your service agreement within three (3) business days of signing for a full refund, in accordance with the FTC's Cooling-Off Rule for home solicitation sales, where applicable.

5.2 Cancellation After Three Days. Cancellations made after the three-day cooling-off period may be subject to a cancellation fee to cover administrative costs and any materials that have been ordered or custom-fabricated. The cancellation fee will be deducted from any refund owed.

5.3 Cancellation by Company. Clean Gutter Protection reserves the right to cancel or decline any project at our discretion. In such cases, any deposits paid will be refunded in full.

5.4 Refund Policy. Refunds for completed work are considered on a case-by-case basis. If you are dissatisfied with our Services, please contact us immediately so we may address your concerns. We are committed to customer satisfaction and will work with you to resolve any legitimate issues.

6. Insurance and Licensing

6.1 Insurance. Clean Gutter Protection maintains comprehensive general liability insurance and workers' compensation insurance as required by law. Certificates of insurance are available upon request.

6.2 Licensing. We maintain all required licenses and permits for the jurisdictions in which we operate. License numbers are available upon request and may be verified with the appropriate licensing authority.

6.3 Permits. If your project requires permits, we will obtain them on your behalf unless otherwise agreed. Permit fees, if any, are the Customer's responsibility and will be included in the project cost.

7. Limitation of Liability

7.1 Limitation of Damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAN GUTTER PROTECTION'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.

7.2 Exclusion of Consequential Damages. IN NO EVENT SHALL CLEAN GUTTER PROTECTION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.3 Pre-Existing Conditions. Clean Gutter Protection is not responsible for pre-existing damage to your roof, fascia, soffit, siding, or other structural components. If we discover pre-existing damage during installation, we will notify you and may recommend repairs before proceeding. Any repairs are subject to additional charges and your approval.

7.4 Disclaimer. We strive to provide reliable services; however, we do not guarantee that our Services will prevent all water damage, ice dams, pest intrusion, or other issues. You acknowledge that gutter protection systems reduce but do not eliminate the need for periodic gutter maintenance and that results may vary based on environmental conditions.

8. Indemnification

You agree to indemnify, defend, and hold harmless Clean Gutter Protection, its owners, officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or regulation; (c) your negligence or willful misconduct; (d) any inaccurate or incomplete information provided by you; or (e) any claim by a third party arising from your use of our Services.

9. Dispute Resolution

9.1 Informal Resolution. Before initiating any formal dispute resolution process, you agree to contact Clean Gutter Protection directly to attempt to resolve any dispute informally. Many concerns can be resolved quickly through direct communication.

9.2 Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in the state where the Services were performed. The arbitration shall be administered by JAMS or another mutually agreed-upon arbitration provider pursuant to its Streamlined Arbitration Rules and Procedures.

9.3 Class Action Waiver. YOU AND CLEAN GUTTER PROTECTION AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

9.4 Small Claims Exception. Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

10. Force Majeure

Clean Gutter Protection shall not be liable for any failure or delay in performing our obligations under this Agreement due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, or any other event beyond our control. In such cases, our obligations will be suspended for the duration of the event, and we will resume performance as soon as reasonably practicable.

11. Intellectual Property

All intellectual property rights, including trademarks, service marks, logos, trade names, patents, copyrights, and content created or provided by Clean Gutter Protection, remain our sole and exclusive property. You agree not to reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any of our intellectual property without our prior written consent. Any unauthorized use may violate copyright, trademark, and other laws.

12. Photography and Testimonials

By engaging our Services, you grant Clean Gutter Protection permission to photograph the completed work and use such photographs for marketing, advertising, and promotional purposes. If you provide a testimonial or review, you grant us permission to use your first name, last initial, city, and testimonial content in our marketing materials. You may opt out of photography or testimonial use by notifying us in writing before the commencement of Services.

13. Independent Contractor

Clean Gutter Protection is an independent contractor. Nothing in this Agreement shall be construed as creating an employer-employee relationship, partnership, joint venture, or agency relationship between you and Clean Gutter Protection.

14. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Services are performed, without regard to its conflict of laws principles. Subject to the arbitration provisions above, any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in the state where the Services were performed, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from this Agreement. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.

16. Entire Agreement

This Agreement, together with any written estimate, proposal, or service agreement provided to you, constitutes the entire agreement between you and Clean Gutter Protection regarding the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. No modification of this Agreement shall be effective unless made in writing and signed by both parties.
